몰수대상재산압수영장 A warrant to seize property subject to forfeiture 이란 법 집행관이 범죄행위와관련이있다고판단되는특정재산 to seize specific property that is believed to be connected to criminal activity 을 압수할 수 있는 권한을 법원에서발행하는법적문서 a legal document issued by a court 입니다.
이 영장은 일반적으로 정부가마약밀매,돈세탁또는기타범죄기업과같은불법활동과관련된자산을몰수 할 근거 the government has grounds to forfeit assets related to illegal activities, such as drug trafficking, money laundering, or other criminal enterprises 가 있는 경우에 발부됩니다.
몰수대상재산압수영장 a warrant to seize property subject to forfeiture 의 주요 사항은 다음과 같습니다.
1. 법적 근거 Legal Basis: 불법활동을통해취득한자산을압수할수있도록하는 to seize assets involved in or acquired through illegal activities 현행법률을기반 usually based on existing laws 으로 해야 합니다.
2. 가능한 원인 Probable Cause: 다른압수수색영장처럼 Just like any other search or seizure warrant 상당한원인이제시되어야 subject to forfeiture requires a showing of probable cause 하고, 이는 법집행기관이 해당자산이범죄행위와관련이있다는합리적믿음을입증하는 demonstrates a reasonable belief that the property is connected to criminal activity 증거를 법원에 제시해야 합니다.
