전화 또는 기타 신뢰할 수 있는 전자수단을 통한 영장신청 application for a warrant by telephone or other reliable electronic means 은 대면 방식이 아닌 원격 방식으로 판사나 치안판사에게 영장을 신청하는 법적 절차로 이 절차는 물리적으로불가능하거나즉각적인조치가필요한긴급상황에 in urgent situations where physical presence may not be feasible or where immediate action is required 서 사용되는데, 주로 다음의 상황과 절차가 전제됩니다.
1. 긴급 또는 특수 상황 Urgency or Special Circumstances :
생명에 대한 잠재적인 위험 potential danger to life, 증거인멸의 위험 또는 기타 긴급한 상황 risk of evidence destruction, or other exigent circumstances 등 즉각적인 조치가 필요한 상황 in situations where immediate action is necessary 에 신청합니다. (법 집행 기관은 임박한 피해나 중요한 증거의 손실을 방지하기 위해 즉시 수색을 하거나 체포해야 할 수 있음 law enforcement might need to conduct a search or make an arrest promptly to prevent imminent harm or the loss of crucial evidence.)
2. 신청 Application Procedure :
영장을 신청하는 개인 또는 법집행관은 영장 발부 사유와 필요성을 자세히 기재한 신청서 제출 formal application that includes detailed information outlining the probable cause and necessity for the warrant 합니다. (신청서에 영장의 필요성을 뒷받침하는 진술서, 진술, 또는 증거를 포함 includes affidavits, statements, or evidence supporting the need for the warrant.)
3. 원격 통신 Remote Communication :
영장신청서는 전화, 화상 회의 또는 기타 보안 전자 수단을 통해 판사나 치안판사에게 제출 application is then presented to a judge or magistrate via telephone, video conference, or other secure electronic means 됩니다.
4. 검토, 고려 Review, Consider
판사는 신청서를 검토하고 제시된 증거를 고려한 후 영장 승인 또는 거부 여부를 결정합니다 judge reviews the application, considers the presented evidence, and makes a decision whether to grant or deny the warrant.
5. 선서 또는 확인 Oath or Affirmation :
영장신청자는 위증 시 처벌을 받는다는 조건 하에 제시된 정보가 자신이 아는 한 최대한 정확하고 사실이라는 선서 진술 또는 증명서를 제출 applicant provides a sworn statement or certification under penalty of perjury that the information presented is accurate and true to the best of their knowledge 합니다.
6. 영장발부, 허가 Authorization :
판사가 충분히 타당한 사유와 긴급성이 인정된다고 판단하는 경우 원격으로 영장을 발부 judge determines there is sufficient probable cause and urgency, they may authorize the warrant remotely 합니다. (이 영장은 법집행기관이나 관련 당국이 영장에 명시된 대로 특정 조치(수색, 압수, 체포 등)를 취할 수 있도록 허용함 this warrant allows law enforcement or relevant authorities to take the specified actions as outlined in the warrant (search, seizure, arrest, etc.)).
이 영장신청 방법은 긴급상황에서 법적절차를 용이하게 하여 법 집행기관이 신속하게 집행하면서도 사법감독과 불합리한 압수수색에 대한 수정헌법 제4조의 보호를 포함한 헌법상의 권리를 준수하도록 to facilitate the legal process in urgent situations, enabling law enforcement to act swiftly while still ensuring judicial oversight and adherence to constitutional rights, including the Fourth Amendment protection against unreasonable searches and seizures 준비되었습니다.
