수색영장 search warrant 은 형사사법제도 criminal justice system 의 중요한 부분으로, 수정헌법제4조 Fourth Amendment 의 불합리한압수수색금지 prohibits unreasonable searches and seizures, 개연성있는근거 must be based on probable cause 조건을 준수해야 합니다.
수색영장신청서 application for a search warrant 는 특정장소나인물에대한수색허가를요청하기위해판사에게제출하는 is submitted to a judge to request permission to search a specific location or person 법적문서로, 범죄의증거가수색장소나사람에게서발견될것 evidence of a crime will be found at the location or on the person to be searched 이라는 합리적믿음,개연성있는근거를제시해야만 must provide probable cause, which is a reasonable belief that 합니다.
수색영장은 일반적으로 법 집행관이 사용하지만 특정상황에서는민간인도발부받을수 can also be obtained by private citizens in certain circumstances 있습니다. 예를 들어, 사립탐정은횡령혐의자의사무실을수색하기위해수색영장을발부받을수 a private investigator may obtain a search warrant to search the office of a suspected embezzler 있습니다.
수색영장을 신청하려면 신청자는 판사에게 서면진술서 written affidavit 를 제출해야 하며 아래의 정보가 포함되어야 합니다.
ㅡ 수색대상(장소나 사람) specific location or person to be searched.
ㅡ 수색항목 items being sought.
ㅡ 수색원인 probable cause for the search .
판사는 진술서를검토 review the affidavit 하고 수색영장을발부할충분한근거가 있는지여부를결정 determine whether there is sufficient probable cause to issue a search warran 합니다.
다음은 구속영장이 주로 사용되는 예입니다.
ㅡ 컴퓨터에서 아동 포르노 또는 기타 범죄의 증거 수색 To search a computer for evidence of child pornography or other crimes.
ㅡ 범죄 증거를 찾기 위해 용의자의 집이나 직장 수색 To search a suspect's home or business for evidence of a crime.
ㅡ 환경오염 또는 기타 규제 위반의 증거를 찾기 위해 기업 수색 To search a business for evidence of environmental violations or other regulatory violations.
ㅡ 무기나 마약 수색 To search a person for weapons or drugs.
ㅡ 차량에서 도난당한 물건이나 마약 수색 To search a vehicle for stolen property or drugs.
ㅡ 기타 규제의 위반 other regulatory violations.
