2021년 10월 1일 현재 미국 법원에서 사용중인 민사소송 서식 Judgment in a Civil Case 입니다.
민사사건판결 Judgment in a Civil Case 은 당사자간의분쟁을해결 resolves the dispute between the parties 하기 위해 법원이내리는최종결정 the final decision made by a court 으로 이것은 사실에대한법원의판단 the court's findings of fact 과 법의결론 conclusions of law 을 명시하고 승소인에게구제를허용하도록명령 orders the relief to be granted to the prevailing party 하는 공식적인서면명령 a formal written order 입니다.
민사사건의판결 a judgment in a civil case 은 법원이재판을마친후또는당사자들이합의한후에내릴수 may be entered by the court after a trial or after the parties have reached a settlement agreement 있습니다.
판결은 원고가피고에대한주장을성공적으로입증한경우에원고에게손해 배상또는기타구제책을부여 may award damages or other relief to the plaintiff if they have successfully proven their case against the defendant 합니다.
그러나 원고가입증책임을다하지못하면사건을기각할수 may dismiss the case if the plaintiff has failed to meet their burden of proof 있습니다.
판결로 The judgment 집행이가능하며 is typically enforceable 패소한자가법원의명령을따르도록강제하는데사용할수 can be used to compel the losing party to comply with the court's orders. 있습니다.
패소자가판결에동의하지않으면 if the losing party disagrees with the decision. 상급법원에항소할수 may be appealed to a higher court 있습니다.
그리고, 민사 사건의 판결은 유죄또는무죄를결정 a determination of guilt or innocence 하고 징역또는벌금과같은처벌을받을수 may result in penalties such as imprisonment or fines 있는 형사판결과는별개 is separate from a criminal judgment 입니다.
