2021년 9월 16일 현재 미국 법원에서 사용중인 민사소송 서식 Summons on Third-Party Complaint 입니다.
제3자소환장 A summons on a third-party complaint 은 소송에서 피고 a defendant 가 제3자에게송달하는법적문서 a legal document that is served on a third party 로 피고가 제3자를 상대로 원고의손해또는상해 plaintiff's damages or injuries 에 대해 전체또는부분적으로책임이있다 is responsible, in whole or in part 고 주장하는 것입니다.
이 소환의 목적은 제3자에게소송에연루되었음을알려주고 to notify the third party that they have been named in the lawsuit 자신의혐의에대해답변할기회를주기 to give them an opportunity to respond to the allegations 위함이며, 제3자는 자신의혐의에대한답변서를제출할 file an answer to the third-party complaint, which is their response to the allegations 수 있습니다.
이 소장은 피고가 제3자가원고의손해또는상해에일부또는전부에 the third party may be responsible for some or all of the damages or injuries alleged by the plaintiff 대해서 책임이있다고믿는경우에만제기된다 is only filed when the defendant believes that 는 점에 유의해야 합니다.
제3자가책임이있는것으로밝혀지면원고에게손해배상또는기타형태의보상을 If the third party is found to be liable, they may be required to pay damages or other forms of compensation to the plaintiff 해야 합니다.
