대배심이 기소에 동의하지 않는, 부동의 한다는 것 (A grand jury's failure to concur in an indictment) 은 누군가를 범죄로 기소할지 여부에 대한 결정을 내릴 수 없다는 것을 의미 (means that they were unable to reach a decision on whether to charge someone with a crime) 합니다.
일반적으로 이것은 증거가 충분하지 않거나 제시된 증거에 대한 배심원 간의 의견 불일치로 (Typically, this could occur due to insufficient evidence or disagreements among the jurors about the evidence presented) 보고됩니다.
동의하지 못한 구체적인 이유 (The specific reasons for the failure to concur) 는 대배심의 보고에 명시되어 절차와 심의 과정들이 자세하게 설명 (would be outlined in the grand jury's report, which would detail the proceedings and the deliberations) 됩니다.
미국형사사법제도에서 대배심이란 범죄가 저질러졌다고 믿을 만한 타당한 근거가 있는지를 판단하기 위해서 검찰측이 제시한 증거를 검토하는 시민들의 집단을 말합니다. (In the US criminal justice system, a grand jury is a group of citizens who review evidence presented by the prosecution to determine if there's probable cause to believe a crime was committed.)
만약 대배심이 검찰의 증거를 인정한다면, 피고를 범죄혐의로 정식기소하는 an Indictment 를 발부합니다. (If they believe so, they issue an indictment, which formally charges the defendant with a crime.)
그러나 대배심이 기소하는 데 필요한 합의 (일반적으로 배심원들의 수 중에서 12명)에 도달하지 못하는 경우, 이를 "부동의, 동의실패" 또는 "무고"라고 합니다. (However, sometimes the grand jury doesn't reach the necessary agreement (typically 12 out of however many jurors) to indict. This is called a "failure to concur" or "no bill.")
부동의, 동의에 실패하면 어떻게 되나? (What happens after a failure to concur?)
피고는 기소되지 않습니다. 대배심에 제시된 증거에 따라서 피고가 형사 기소를 당하지는 않겠지만, 그렇다고 해서 나중에 새로운 증거가 밝혀지더라도 피고를 기소할 수 없다는 뜻은 아닙니다. (No charges. The defendant doesn't face criminal charges based on the evidence presented to the grand jury. This doesn't mean they can't be charged later if new evidence comes to light.)
대배심이 부동의 할 경우 검찰은 다음 조치들을 취할 수 있습니다. (The prosecutor can;)
ㅡ 사건재청구 Re-present the case: 더 많은 증거를 수집하고, 사건의 취약점을 보완하고, 새로운 대배심원단에 청구할 수 있습니다.(can gather more evidence, address weaknesses in their case, and try presenting it to a new grand jury.)
ㅡ 사건기각 Drop the case: 더 이상 기소하지 않기로 결정할 수 있습니다. (might decide not to pursue charges any further.)
ㅡ 직접기소요청 Seek a direct indictment: 일부 관할권에서는 검사가 대배심원을 거치지 않고 판사에게 직접 기소를 요청할 수 있습니다(일반적이지 않음). (In some jurisdictions, prosecutors can bypass the grand jury and seek an indictment directly from a judge (less common)).
다음과 같은 경우에 대배심은 기소에 부동의 합니다. (Why might a grand jury not indict? There are several reasons:)
ㅡ 불충분한증거 Insufficient evidence: 배심원은 검찰측이 원인을 입증할 만큼 충분한 증거를 제시하지 않았다고 생각할 경우입니다. (The jurors may feel the prosecution hasn't presented enough evidence to establish probable cause.)
ㅡ 증인신뢰도 Witness credibility issues: 배심원이 검찰측이 제시한 주요 증인의 신뢰성을 의심할 경우입니다. (The jurors might doubt the credibility of key witnesses presented by the prosecution.)
ㅡ 법적문제 Legal issues: 배심원이 증거수집의 합법성에 우려할 경우입니다. (The jurors might have concerns about the legality of how evidence was obtained.)
ㅡ 혐의부동의 Disagreement on the charges: 배심원이 피고를 상대로 제기할 구체적인 혐의에 동의하지 않을 경우입니다. (Jurors might not agree on the specific charges to bring against the defendant.)
ㅡ 기밀성 Confidentiality: 대배심의 부동의 보고서는 기밀 문서로서 이것은 피고의 사생활을 보호하고, 검찰이 사건에서 잠재적으로 취약한 면이 공개되는 것을 방지하기 위해서 기밀성이 필요하다가 판단한 경우입니다. (A report of a grand jury's failure to concur is usually a confidential document. This protects the privacy of the defendant and prevents the disclosure of potentially weak aspects of the prosecution's case.)
대배심의 부동의는 무죄의 표시인가? (Is a grand jury's failure to indictit a sign of innocence?)
아닙니다. 기소에 부동의 한다고 피고가 무죄라는 뜻이 아닙니다. 대배심이 현재 진행하기에는 충분한 증거를 찾지 못했다는 것을 의미하므로, 이후에 피고에게 추궁될 수 있고, 대배심에 제출되지 않은 다른 범죄에 대해서 피고가 유죄를 선고받을 수도 있습니다. (No. A failure to indict doesn't mean the defendant is innocent. It just means the grand jury didn't find enough evidence to move forward at this time. The case could be pursued later or the defendant might be guilty of a different crime not presented to the grand jury.)
