대배심증언소환장 A subpoena to testify before a grand jury은 대배심에 증인으로 출석하여 증언하도록 강제하는 법적 문서로 법원이 발행하며 다음의 사항들이 요구됩니다.
먼저, 소환장을 받았다고 해서 반드시 범죄 용의자라는 의미는 아니지만 소환을 무시해서는 안되니 우려 사항이 있는 경우 변호사와 상담하시기 바랍니다.
1. 통지 Notification: 소환에 대한 공식 통지를 증인의 집이나 직장으로 전달합니다. You will receive official notification of the subpoena. This could come in the form of a document delivered to your home or workplace.
2. 세부내용 Details: 대배심에 출석해야 하는 소환형식, 소환자 성명과 주소, 법원명과 위치, 사건명과 사건번호, 출석일시가 기재됩니다. The subpoena will outline the subpoena type("Subpoena Ad Testificandum" indicating it requires the recipient to testify), recipient full name and address of the individual being subpoenaed, the name and location of the court issuing the subpoena, the name and identifying number of the legal case associated with the grand jury, the date, time where to appear before the grand jury.
3. 지시사항 Instructions: 관련 사건과 관련된 문서나 기타 증거물을 가져와야 할 사항이 명시됩니다. It may include instructions on what you need to bring with you, such as documents or other evidence relevant to the case.
4. 의무 Obligation: 소환을 받은 자는 소환 조건을 준수해야 하며 준수하지 않을 경우 법정모독죄로 기소될 수 있습니다. As a recipient of the subpoena, you are legally obligated to comply with its terms. Failure to do so could result in legal consequences, such as being held in contempt of court.
5. 법률자문 Legal Counsel: 소환장에 대해 법률자문을 구할 수 있고 변호사는 어떻게 대응해야 하는지 지침을 알려주고 진행 과정에서 귀하의 이익을 대변할 수 있습니다. You have the right to seek legal counsel if you have any concerns or questions about the subpoena. An attorney can provide guidance on how to proceed and represent your interests during the proceedings.
6. 증언 Testimony 증언: 대배심에 출석하면 선서를 하고, 검사와 대배심원들의 질문에 성실하게 답변해야 합니다. During your appearance before the grand jury, you will be sworn in and required to testify truthfully in response to questions asked by the prosecutor and possibly members of the grand jury.
7. 기밀성 Confidentiality: 대배심 절차는 기밀하게 진행되므로, 증언 세부사항을 다른 사람과 논의하지 말아야 합니다. Grand jury proceedings are typically confidential, so you may be instructed not to discuss the details of your testimony with others.
