2023년 8월 1일 현재 미국 법원에서 사용중인 형사소송 Application for a Tracking Warrant 서식 입니다.
미국 법원에서 추적영장신청에는 조사에 대한 자세한 정보와 추적영장이 필요한 이유를 작성한 진술서가 첨부되어야 합니다.
진술서에는 다음이 포함되어야 합니다.
* 피고인이 범한 것으로 의심되는 특정 범죄.
* 정부가 피고가 범죄에 연루되어 있다는 증거.
* 정부가 피고인의 휴대전화를 추적하면 범죄의 증거가 드러날 것이라고 믿는 이유.
* 추적 장치가 설치될 특정 위치.
* 추적 영장의 기간.
추적영장 신청서는 피고가 소재한 지역의 판사에게 제출하고, 판사는 신청서를 검토하고 영장 발부 여부를 결정합니다. 영장이 발부되면 피고의 휴대폰에 추적 장치를 설치하고 사용할 수 있는 권한을 갖게 됩니다.

APPLICATION FOR A TRACKING WARRANT
I, a federal law enforcement officer or attorney for the government, have reason to believe that the person,
property, or object described above has been and likely will continue to be involved in one or more violations of _____________ U.S.C. § ____________. Therefore, in furtherance of a criminal investigation, I request authority to install and
use a tracking device or use the tracking capabilities of the property or object described above to determine location. The application is based on the facts set forth on the attached sheet.

The warrant application should be accompanied by an affidavit that provides more detailed information about the investigation and the reasons why the tracking warrant is necessary. The affidavit should also include the following information:
* The specific crime that the defendant is suspected of committing.
* The evidence that the government has that the defendant is involved in the crime.
* The reasons why the government believes that the tracking of the defendant's cellular telephone will reveal evidence of the crime.
* The specific location where the tracking device will be installed.
* The duration of the tracking warrant.
The warrant application should be submitted to a judge in the district where the defendant is located. The judge will review the application and decide whether to issue the warrant.
