2023년 4월 16일 현재 미국 법원에서 사용중인 형사소송 Commitment to Another District 서식 입니다.
미국 법원에서 이송결정 Commitment to Another District 는 범죄 피고인이 범행 지역의 법원에서 재판을 받지만, 이전에 다른 지역에서 저지른 범죄로 다른 지역에서 재판을 받으려고 피고인이 현재의 법원에 이의를 제기하면 Commitment to Another District 절차가 진행됩니다.
피고인이 한 연방 지역에서 체포되었어도 범죄를 저지른 다른 연방에서 기소되기를 원하면 그 지역으로 구금되어 기소될 수 있는 이 절차는 피고인이 다른 지역으로 이송될 수 있는 합법적인 근거가 있는지를 검토합니다. 그리고 피고인이 다른 지역으로 이송될 경우 피고인의 권리가 보호될 수 있도록 합니다.
다음은 대법원의 이송결정 Commitment to Another District 과 관련된 판례입니다.
1. United States v. Bautista-Galvez, 346 F.3d 145 (2d Cir. 2003). 이 사건 피고인은 추방된 후 미국에 불법으로 다시 재입국한 혐의로 뉴욕에서 체포되었으나 피고인이 과거에 마약 밀매죄를 저지른 애리조나주에서 기소되기를 원해 뉴욕주에서 애리조나로 이송되었음.
2. United States v. Cortes-Sanchez, 387 F.3d 1032 (9th Cir. 2004). 이 사건 피고인은 마약밀매죄로 캘리포니아주에서 체포되었으나 피고인이 다른 마약 밀매죄로 텍사스주에서 기소되기를 원해 캘리포니아주에서 텍사스로 이송되었음.
3. United States v. Melendez-Morales(2008). 이 사건에서 대법원은 2006년의아담월시아동보호및안전법에따라 under the provisions of the Adam Walsh Child Protection and Safety Act of 2006 법원이 정신과 치료를 위해 피고를 다른 지역으로 보내도록 명령할 수 있는지에 대한 문제를 고려하였고, 대법원은 피고에게명령에이의제기할수있는즉각적인심리가제공되는한 as long as the defendant is provided with a prompt hearing to challenge the commitment order 그법이헌법의정당한적법절차조항이나 수정헌법제6조의속결재판보장규정을위반하지않는다 the Act's provisions did not violate the Constitution's Due Process Clause or the Sixth Amendment's guarantee of a speedy trial 라고 판결함.
4. United States v. Peterson(1974). 이 사건은 피고가원래지역에서기소되거나재판을받지않았더라도 even if the defendant had not been indicted or tried in the original district 법원이 재판을 위해 피고를 다른 지역으로 이송할 수 있는지 여부를 고려하였고, 대법원은 피고인이원래지역에서공정한재판을받을수없고,이송이정의를위한것이라면 이송할수있다 a defendant could be transferred if it is shown that the defendant cannot receive a fair trial in the original district, and that the transfer is in the interests of justice 라고 판결함.

IT IS ORDERED: The United States marshal must transport the defendant, together with a copy of this order, to the charging district and deliver the defendant to the United States marshal for that district, or to another officer

The marshal or officer in the charging district should immediately notify the United States attorney and the clerk of court for that district of the defendant’s arrival so that further proceedings may be promptly scheduled. The clerk of this district must promptly transmit the papers and any bail to the charging district.
