2023년 4월 6일 현재 미국 법원에서 사용중인 형사소송 Warrant by Telephone or Other Reliable Electronic Means 서식 입니다.
전화또는기타신뢰할수있는전자수단에의한영장 Warrant by Telephone or Other Reliable Electronic Means 은 judge 또는 magistrate authorizes law enforcement officers 가 검사, 경찰, 관리관 같은 법 집행관에게 physical warrant 없이도 수색, 체포 또는 기타 법적 조치를 취할 수 있는 권한을 부여하는 법적 절차입니다.
시급한 상황에서 physical warrant 을 발급 받는데 시간이 촉박하여서 피해 및 증거 소실이 예상될 때 이를 방지하기 위해서 발부됩니다.
이 영장은 범죄가 이미 발생하였거나 곧 발생할 것으로 추정이 되면서 수색 영장이 피해나 증거의 소실을 방지하는 데 꼭 필요하다는 것을 확언하는 진술서를 법원에 제출해야 합니다. 이 영장은 남용을 방지하기 위해 엄격한 법적 기준에 따른 감독을 받으며 법 집행관이 특정 절차와 규정에 따라 얻은 증거들은 법정에 입증해야 합니다.
한편 피고인은 이 과정을 통해서 얻은 이 영장의 유효성이나 적법성에 대해 미국 법원에 이의를 제기할 수 있습니다.
다음은 미국 대법원의 Warrant by Telephone or Other Reliable Electronic Means 관련 사건 판례입니다.
1. Illinois v. Gates (1979). 이 사건은 미국 경찰이 의심되는 대상의 자택을 수색하기 위해 전화로 영장을 발급 받은 경우이며, 대법원은 전화 또는 기타 신뢰할 수 있는 전자 수단을 통해 영장을 발부 받는 것이 physical warrant 를 발부 받는 것보다 법적으로 적절하다고 판결함. physical warrant 발부가 긴급한 상황에서는 불가능할 수 있기 때문이라며 Warrant by Telephone or Other Reliable Electronic Means 발부는 합법적일 조건으로 판사가 충분한 증거와 보증을 기반으로 해서 발부를 결정해야 한다고 명시했고 이 판결 이후로 미국에서는 전화나 기타 신뢰할 수 있는 전자 수단을 통한 영장 발급이 긴급한 상황에서 적법하게 이루어질 수 있게 규정.
2. United States v. Jones (2012). 이 사건은 경찰이 영장 없이 의심되는 마약 딜러인 Antoine Jones의 차량에 GPS 추적 장치를 설치해서 28일 동안 동선을 모니터링해 마약 혐의로 체포하고 유죄 판결을 받게 한 사건으로 피고인 Jones는 영장도 없이 GPS 추적 장치를 사용하는 것은 부당한 수색 및 압수에 대한 수정 헌법 제4조의 권리를 침해했다며 판결에 항소했고 대법원은 차량에 GPS 추적 장치를 설치해 지속적으로 모니터링한 것은 사유 재산에 대한 물리적 침입에 해당하고 장기간에 걸친 모니터링은 상당한 사생활 침해에 해당한다고 지적하며 영장 없는 GPS 추적으로부터 개인을 보호하고 그러한 추적이 개인 프라이버시에 대한 합리적인 기대를 위반하는 것이라고 판결.
3. Riley v. California (2014). 이 사건은 경찰이 David Leon Riley 의 휴대폰을 영장없이 수색한 결과 갱단총격사건 관련 증거가 발견되어 그는 유죄 판결을 받았고 그래서 영장 없이 휴대전화를 수색한 것은 부당한 수색과 압수에 대한 수정 헌법 제4조의 권리를 침해했다는 이유로 상고함. 대법원은 영장 없이 휴대전화를 수색한 것은 수정헌법 제4조의 권리를 침해했다고 판결하면서 휴대폰은 지갑과 같이 체포 시 수색될 수 있는 다른 물리적 물체와 근본적으로 다르다며 사진, 동영상, 이메일, 인터넷 검색 기록 등 체포 자체와 관련이 없는 방대한 양의 개인 정보가 포함되어 있다고 지적했고 휴대폰 수색은 물리적 물체 수색보다 개인의 집이나 사무실 수색에 더 가까워 수정 헌법 제4조의 영장 요건이 적용되므로 경찰은 체포시 압수한 휴대폰을 수색하기 전에 반드시 영장을 받아야 한다고 규정함. 이 판례는 법 집행 기관의 휴대전화 수색과 디지털 시대의 수정 헌법 제4조 보호 범위에 중대한 영향을 끼침.
