압수수색영장 Search and Seizure Warrant 은 법 집행기관들 authorize law enforcement officials 이 범죄 수사나 기타 법적 문제를 해결하기 위해 사적 재산 또는 일반 공공 장소를 수색하고 압수할 수 있도록 하는 법원의 명령서입니다.
이 영장은 판사 judges 나 치안판사 magistrates 가 합법적으로 수집된 증거를 바탕으로 발부되는데, 수사할 대상의 집, 사무실, 차량, 사물함 등을 압수수색할 영장에는 정확하고 구체적으로 세부사항 즉 장소, 일시, 대상의 신원, 수색 과정에서 취할 조치 등을 명확히 명시해야 합니다.
법원은 영장을 발부하기 전에 증거가 충분한지, 왜 수색이 필요한지를 심사하여서 합법적으로 수집된 증거에 따라서 발부하며, 이 영장은 범죄 수사에 필수적이며, 합법적으로 발부된 수색 영장에 따라 법집행기관은 적법하게 수집한 증거를 법원에 제출하여 범죄 수사를 진행합니다.
그러나 부적절하게 발부된 압수수색 영장으로 취득한 증거는 법원에서 인정되지 않아 수사가 무효가 될 수도 있습니다.
다음은 미국 대법원의 압수수색영장 Search and Seizure Warrant 관련된 사건의 판례입니다.
1. Mapp v. Ohio, 367 U.S. 643 (1961). 이 사건에서 대법원은 불법 압수수색을 통해서 얻은 증거는 주 형사 소송에서 허용되지 않는다고 판결했고 이 판결로 인해서 수정 헌법 제4조를 위반하여 얻은 증거가 법정에서 피고인에게 불리하게 사용되는 것을 배제하는 배제 규칙 exclusionary rule 이 확립.
2. Katz v. United States, 389 U.S. 347 (1967). 이 사건에서 대법원은 수정헌법 제 4 조가 개인의 사적인 대화에 대한 영장 없는 검색으로부터 개인을 보호하며 전화 도청을 하려면 영장이 필요하다고 판결. 이 판결로 "프라이버시에 대한 합리적인 기대 reasonable expectation of privacy" 의 개념이 확립되고 수정 헌법 제4조의 범위를 확장함.
3. United States v. Leon, 468 U.S. 897 (1984). 이 사건에서 대법원은 유효하지 않은 영장에 합리적으로 의존하여 수행된 수색을 통해서 얻은 증거일지라도 법집행공무원이 선의로 행동한 경우 증거로 채택될 수 있다고 판결해 이 판결로 배제 규칙에 선의의예외 good faith exception 를 확립.
4. Maryland v. Buie, 494 U.S. 325 (1990). 이 사건에서 대법원은 법 집행관이 자신의 안전에 위험이 있을 수 있다는 합리적인 믿음이 있는 경우 영장 없이도 건물을 보호할 수 있다며 메릴랜드 항소법원의 판결을 파기하고 추가 절차를 위해 해당 법원에 사건을 환송. 대법원은 경찰이 체포시 안전을 위해 합리적인 조치를 취하는 것이 허용되고, 수정 헌법 제4조의 이익에 가능한 침해이며, 수색영장 없이도 예방차원에서는 상당한 이유나 합당한 의심이 없어도 조사할 수 있는데, 이것은 합리적 추론과 함께 경찰이 위험한 인물이 숨어 있다고 증명해야 한다고 판결. 이 판결로 보호를 위해 영장 없이 제한적으로 수색하는 "보호스윕 "protective sweeps" 의 사용을 확립함.
5. Riley v. California, 573 U.S. (2014). 이 사건에서 대법원은 수정 헌법 제4조에 따라 법집행관이 체포를 위해 휴대전화 압수 사건을 수색하기 전에 영장을 받아야 한다고 판결. 법원은 최신 휴대전화에 방대한 양의 개인 정보가 포함되어 있다는 점을 인식하고 휴대전화 검색이 다른 물리적 수색보다 더 피해를입는 more invasive 다고 판결.
