2023년 3월 6일 현재 미국 법원에서 사용중인 형사소송 서식 Criminal Complaint 입니다.
형사고발 Criminal Complaint 는 고소인 complainant 이 피의자 accused (범죄를 저지른 개인이나 집단) 에 대한 고소를 제기하기 위해 검사가 제출한 기소 문서를 말합니다.
고소장에는 피의자에 대한 구체적인 혐의를 설명하고, 범행 날짜와 장소, 혐의를 뒷받침하는 증인이나 증거 등 고소를 위한 정보, 그리고 유죄 판결을 받았을 때 부과될 수 있는 처벌을 포함한 범죄 혐의를 기재합니다.
형사고발이 제기되면 판사는 증거를 검토하고 혐의가 입증되면 체포 영장이 발부될 수 있습니다.
피의자는 무죄를 주장할 수 있고 합의가 이루어지지 않을 경우 재판이 진행됩니다.
다음은 미국 대법원의 형사고발 Criminal Complaint 관련 판례입니다.
1. United States v. Nixon, 418 U.S. 683 (1974). 이 사건에서 대법원은 형사 재판에서 증거를 제공하기 위해 미국 닉슨 대통령을 소환하려고 형사고발을 할 수 있다고 판결. 대법원은 "행정특권원칙 doctrine of executive privilege" 이 대통령이 범죄수사와 관련된 증거를 보류 withhold evidence 하는 것을 허용하지 않는다고 판결.
2. United States v. Alvarez, 567 U.S. 709 (2012). 이 사건에서 대법원은 무공훈장수여 receiving military honors 에 관한 허위 진술을 범죄로 규정한 Stolen Valor Act 법이 수정 헌법 제1조를 위반했는지 여부를 고려했음. 이 법이 실질적인 해를 끼치지 않는 발언을 처벌하고 발언 제한을 정당화하는 "강력한 이익 compelling interest" 을 구성하지 않기 때문에 위헌이라고 판결.
3. United States v. Enmons, 410 U.S. 396 (1973). 이 사건에서 대법원은 노조 간부가 홉스법 Hobbs Act 에 따라 갈취 혐의로 기소될 수 있는지 여부를 고려했음. 대법원은 Hobbs Act 이 불법적인 수단을 사용하더라도 노조를 위해 정당한 이익을 추구하는 노조 간부에게는 적용이 되지 않는다고 판결.
4. United States v. Gottesman, 724 F.2d 1517 (11th Cir. 1984). 이 사건에서 피고 Gottesman 는 조합자금횡령 embezzlement of union funds 혐의로 기소되었고 피고인은 고소에서 주장하는 사실에 구체적 진술이 포함되어 있지 않았다며 고소가 불충분하다고 주장했음. 이에 대법원은 형사 고발은 피고의 혐의에 대한 "공정한 통지 fair notice" 만 하면 된다고 피고의 주장을 기각.
5. Miranda v. Arizona (1966). 이 사건에서 대법원은 범죄용의자 criminal suspects 가 경찰의심문을받기전에 before they are questioned by police 자신의권리를고지받아야 must be informed of their rights 한다고 판결. 이러한 권리에 묵비권 the right to remain silent 과 변호사를선임할권리 the right to an attorney 가 포함됨.
6. Gideon v. Wainwright (1963). 이 사건에서 대법원은 형사피고인 criminal defendants 이 사정상 변호사를선임할수없더라도 변호사선임권리가있다 have the right to an attorney, even if they cannot afford one 고 판결함. 이 결정은 형사사건에서빈민변호의원칙을확립 This decision established the principle of indigent defense in criminal cases.했음.
7. Batson v. Kentucky (1986). 이 사건에서 대법원은 검사가 prosecutors 인종만을근거로 based solely on their race 적격배심원 potential jurors 을 배제하기위해 to remove 강제기피 peremptory challenges 를 할 수 없다고 판결. 이 결정으로 배심원선정과정에서인종차별을방지 to combat racial discrimination in the jury selection process 하게 됨.
8. Terry v. Ohio (1968). 이 사건에서 대법원은 경찰이 개인이범죄활동에연루되어있다고합리적으로의심되는경우 if they have reasonable suspicion that the person is involved in criminal activity 개인을잠시구금하고수색을허용하는 allows police officers to briefly detain and search individuals "신체검색및압수"원칙을확립 established the "stop and frisk" doctrine 했음.
9. District of Columbia v. Heller (2008). 이 사건에서 대법원은 미국수정헌법제2조 the Second Amendment of the United States Constitution 가 가정내에서자기방어와같은 such as self-defense in the home 합법적인목적을위해 개인이총기를소지할수있는권리를보호 protects an individual's right to possess a firearm for lawful purposes 한다고 판결.
