형사사건기탁증언소환장 Subpoena to Testify at a Deposition in a Criminal Case 은 미국 법원에서 형사사건 조사의 증인 witnesses 으로 출석해서 증언 testimony 할 것을 명령하는 법적 명령서입니다.
형사 사건의 증언에 대한 소환장은 범죄 수사 또는 재판의 일부로 출석하여 선서하에 증언 testimony 시키는 것이며, 목적은 법정에서 사용될 수 있는 증거와 정보를 수집하는 것입니다. 검찰이나 피고인 측에서 증언 을 위한 소환장 Subpoena 을 발급할 수 있고, 소환장에는 선서 날짜, 시간, 장소, 증언방법에 대한 지침을 기재합니다.
소환장 Subpoena 을 받은 증인 witnesses 은 자신의 법적 권리와 의무를 이해해야 합니다. 만일 소환장에 응하지 않으면 벌금 및 법정모독죄로 체포될 수 있습니다.
기탁증언 Deposition testimony 은, 조사나 정식 재판 전의 절차로 법원이나 법률사무소에서 증인, 당사자, 전문가들이 선서 oath 하고 증언을 기탁하는 것입니다.
선서증언 Oath testimony 은, 증인 witnesses 이 선서 oath 하에 증언 testimony 을 하는 재판 전의 과정으로 법원 속기사가 기록을 하고 재판에서 증거로 사용될 수 있습니다.
형사 사건에서 증언을 위해 소환장을 발부할 수 있는 경우는 다음과 같습니다.
1. 대배심 조사 Grand Jury Investigations : 대배심은 범죄 활동을 조사하기 위해 정부가 소집한 시민 집단으로 증인은 형사 사건에 대한 조사의 일환으로 대배심 증언에서 증언하도록 호출될 수 있음.
2. 형사 재판 Criminal Trials : 증인은 형사 재판의 일부로 증언하도록 호출될 수 있다. 기탁증언 Deposition testimony 은 재판 중에 증인의 증언을 impeach 하거나 증인이 법정에서 증언할 수 없는 경우 증거로 사용될 수 있음.
3. 플리 바게인 Plea Bargains : 플리 바게인은 재판을 거치지 않고 형사 사건을 해결하기로 한 검사와 피고 사이의 합의로 증인은 유죄 협상과정의 일부로 증언을 위해 호출될 수 있음.
4. 유죄 판결 후 구제 Post-Conviction Relief : 형사 유죄 판결을 받은 후 피고는 항소 appeal 또는 인신보호 영장 청원 habeas corpus petition 과 같은 유죄 판결 후 구제를 요청할 수 있다. 증인은 유죄 판결 후 구제 절차의 일부로 증언하도록 호출될 수 있음.
다음은 대밥원의 Subpoena to Testify at a Deposition in a Criminal Case 판례입니다.
1. Branzburg v. Hayes(1972). 이 사건에서 대법원은 기자들이 범죄 수사에서 기밀정보소스 confidential sources 에 대해 대배심원 a grand jury 앞에서 증언하도록 강요받을 수 있다고 판결함.
2. United States v. Nixon(1974) - 이 사건은 리처드 닉슨 대통령이 워터게이트 스캔들과 관련된 테이프 녹음 및 기타 문서를 제작하도록 소환장을 받은 사건으로 대법원은 범죄 수사와 관련된 증거를보류하는것에 to withhold evidence 행정특권 executive privilege 을 사용할 수 없다고 판결함.
3. United States v. R. Enterprises(1983) - 이 사건에서 대법원은 범죄 수사에서 비즈니스기록 business records 에 대한 소환장이 부당한압수수색 unreasonable searches and seizures 에 대한 수정헌법 제4조의 금지를 위반하지 않는다고 판결함.
4. Kastigar v. United States (1972) - 이 사건은 면책허가하에얻은 was obtained under a grant of immunity 증언을 증인이 형사 사건에서 강제로 증언할 수 있는지의 문제에 대해서 대법원은 강제증언에면책특권을부여할수있지만 immunity could be granted to compel testimony 검찰은증인의증언에서파생된어떠한정보도사용할수없다 but that the prosecution could not use any information derived from the testimony against the witness 고 판결함.
