경범죄사건치안판사처리동의서 Consent to Proceed Before a Magistrate Judge in a Misdemeanor Case 는 피고인이 경범죄 사건을 지법판사 district judge 대신에 치안판사 magistrate judge 에게 심리하도록 선택하겠다는 자발적인 정보에 기반한 법적 동의서입니다.
많은 경범죄 misdemeanor 사건들에서 피고인은 지법판사의심리를받을권리 the right to have their case heard by a district judge 를 포기하고 magistrate judge 가 사건을 심리하도록 선택할 수 있습니다.
치안판사 magistrate judge 는 지법판사 district judge 의 감독하에 경범죄 사건 같은 특정 형사사건을 처리할 권한이 있으며 영장을 발부하고 보석금을 정하며 예비심사를 진행할 수 있습니다.
만약 피고인이 이 동의서에 서명하여 지법판사 magistrate judge 에 의해 사건이 처리가 되면 나중에 지법판사 district Judge 에 대한 항소권이 없어집니다.
경범죄 사건에서 치안판사의 권한과 그 절차에서 피고인의 권리 범위에 대한 중요한 지침을 제공하지만 모든 경범죄 사건이 치안판사에게 처리를 받을 수 있는 것은 아니니 이 선택권이 자신의 사건에 적용되는지 확인을 해야 합니다.
다음은 Consent to Proceed Before a Magistrate Judge in a Misdemeanor Case 관련 판례입니다.
1. 교통위반 Traffic violations : 과속 speeding, 신호 위반 running a red light 또는 무면허 운전 driving without a license 과 같은 많은 교통 위반 traffic violations 은 경범죄 misdemeanors 로 분류되고 이러한 위반의 피고인은 Magistrate Judge 가 자신의 사건을 심리하도록 선택할 수 있다.
2. 무질서 Disorderly conduct : 무질서한 행위는 magistrate judge 앞에서 진행하기로 동의하는 일반적인 경범죄 misdemeanors 로서 이 혐의는 싸움 fighting, 평화를 방해 disturbing the peace 하거나 음란한 행위에 가담 engaging in lewd conduct 하는 것과 같은 광범위한 행동 a wide range of behaviors 에 적용될 수 있다.
3. 경미한 마약범죄 Minor drug offenses : 소량의 마리화나 small amounts of marijuana 또는 마약 도구 drug paraphernalia 를 소지 possession 한 것과 같은 일부 마약 범죄는 경범죄 misdemeanors 로 분류되고 이러한 범죄의 피고인은 magistrate judge 가 자신의 사건을 심리하도록 선택할 수 있다.
다음은 대법원의 Consent to Proceed Before a Magistrate Judge in a Misdemeanor Case 관련 판결입니다.
1. United States v. Raddatz (1986). 이 사건에서 대법원은 치안판사가중죄사건의심리를진행하도록 to have a magistrate judge conduct a hearing in a felony case 선택하는 피고의동의 a defendant's consent 가 적법절차의요건을충족했다 was sufficient to satisfy the requirements of due process 고 판결함. 대법원은 또한 피고인이 지방법원판사의 새로운검토를받을권리가보존되는한 as long as the defendant's right to a de novo review by a district judge is preserved 경범죄사건에서당사자들의동의를얻어 in misdemeanor cases with the consent of the parties 특정재판전절차를수행할수있는권한부여 may be authorized to conduct certain pretrial proceedings 를 치안판사 a magistrate judge 에게 할 수 있다고 판결.
2. Gomez v. United States (1989). 이 사건에서 대법원은 수정헌법제6조에따른 under the Sixth Amendment 배심원재판에대한피고의권리 a defendant's right to a jury trial 는 피고가지법판사에대한권리를알고서포기하는한 as long as the defendant is informed of and waives the right to a district court judge 치안판사가중범죄사건에서유죄인정심리를진행하도록허용함으로써침해가되지
는않는다 is not violated by allowing a magistrate judge to conduct a guilty plea hearing in a felony case 고 판결함.
3. Peretz v. United States (1991). 이 사건에서 대법원은 지법판사가사건에궁극적인권한을유지하는한 as long as the district court judge retained ultimate authority over the case, 치안판사가피고인의동의를얻어경범죄재판을할수있다 a magistrate judge could preside over a misdemeanor trial with the defendant's consent 고 판결.
4. United States v. Williams(2002). 이 사건에서 대법원은 피고인이치안판사와유죄협상중에변호인을선임할권리 a defendant's right to counsel during plea bargaining with a magistrate judge 문제를 다룬 것으로, 대법원은 사건이 경범죄 혐의에관련된경우라도 even if the case involves only misdemeanor charges 피고인이치안판사와유죄협상중에변호인을선임할권리가있다 a defendant has a right to counsel during plea negotiations with a magistrate judge 고 판결.
5. Alabama v. Shelton (2002). 이 사건은 경범죄형사재판에서피고인의변호사선임권리 a defendant's right to counsel during a misdemeanor criminal trial 문제를 다룬 것으로 대법원은 수정헌법제6조 the Sixth Amendment 에서 경범죄사건을포함한 including misdemeanor cases, 피고가징역에처해질가능성이있는모든사건에서는 in any case in which the defendant faces a potential term of imprisonment 가난한피고인 an indigent defendant 을 위한 변호인선임 the appointment of counsel 을 요구한다고 판결.
