2023년 1월 2일 현재 미국 법원에서 사용중인 민사소송 Complaint for Violation of Civil Rights (Prisoner) 서식입니다.
미국 법원에 인권침해로인한진정(수감자) Complaint for Violation of Civil Rights (Prisoner) 은 구금 중에 수감자 자신의 인권이 침해되었다고 생각될 때 취하는 법적 조치입니다.
수감자의 인권은 수감되는 동안 인도적이고 공정하게 대우 받을 수 있도록 법으로 보호 받으므로 침해되었을 때 진정할 수 있습니다.
진정을 하기 위해서는 진정서/소장에 침해 사실을 기재하고 주장을 뒷받침할 증거를 제출해야 하며, 수감자는 진정 신청을 위한 법률 시스템을 이해하고 법적 조치를 위한 절차를 따라야 합니다.
수감자가 인권침해로 진정할 수 있는 경우들입니다.
1. 보복 Retaliation : 수감자 prisoner 가 고충을 토로 filing grievances 하거나 기타 보호받을 활동에 참여한 행사 engaging in other protected activities 또는 인권침해신고 reporting a civil rights violation. 에 대해 보복을 당했다고 생각하는 경우.
2. 부적절한 의료 서비스 Inadequate medical care : 구금 중에 while in custody 적절한 의료서비스를 받지 못하여 were denied adequate medical care 피해를 입었다 resulting in harm 고 생각하는 경우.
3. 법원 접근 Access to courts : 변호사접견 legal counsel 이나 법률도서관자료 law library materials 와 같은 법률 자원 legal resources 과 법원에 접근이 제한 was restricted/denied access to courts 되어 법적조치를 취할 능력을 방해한다 hindering their ability to pursue legal action 고 생각하는 경우.
4. 차별 Discrimination : 인종, 성별, 종교 또는 장애를 이유로 차별을 받았다고 생각하는 경우.
5. 과도한 무력 사용 Use of excessive force : 교도관이 과도한 폭력을 가하여 부상을 입었다고 생각하는 경우.
6. 안전하지 않거나 비인간적인 생활 조건 Unsafe or inhumane living conditions : 과밀 overcrowding, 독성물질에 대한 노출 exposure to toxic substances 또는 적절한 위생시설 부족 lack of adequate sanitation 과 같은 안전하지 않거나 비인간적인 생활 조건에 노출되었다고 생각하는 경우.
다음은 미국 대법원의 수감자인권침해 Complaint for Violation of Civil Rights (Prisoner) 에 대한 판례입니다.
1. Cooper v. Pate (1964). 이 사건은 교도소 관리자들이 이슬람 종교 자료에 대한 접근을 거부함으로써 그의 헌법적 권리가 침해되었다고 주장한 교도수를 다룬 것으로, 재소자가1871년인권법에따라인권소송을제기할권리가있다 prisoners have a right to bring a civil rights lawsuit under the Civil Rights Act of 1871 는 것을 대법원에서처음인정한사건임 was the first in which the Supreme Court recognized.
2. Estelle v. Gamble (1976). 이 사건은 수감자 an inmate's 의 중대한의료치료요구 serious medical needs amounted 에 대한 고의적인무관심 whether deliberate indifference 이 잔인하고비정상적인처벌 prohibition against cruel and unusual punishment 에 대한 수정헌법제8조의위반 to a violation of the Eighth Amendment's 에 해당되는지를 다루었고, 대법원은 수감자도적절한치료를받을수있는권리를확립 establishing an inmate's right to adequate medical care 했음.
3. Turner v. Safley (1987). 이 사건은 수감자 inmate 의 서신및결혼 correspondence and marriage 제한 restrictions on 문제를 다루었고, 대법원은 교도관 prison officials 이 재소자의 서신 및 결혼을 규제할수있는폭넓은재량권을가지고 have broad discretion to regulate 있지만그러한규제는정당한형벌적이익과합리적으로연결되어야한다 but that such regulations must be reasonably related to legitimate penological interests 고 판결함.
4. Lewis v. Casey (1996). 이 사건은 재소자들이 법률도서관이용과법률지원을받을권리가있음 prisoners have a right to access law libraries and legal assistance 을 주장하였고, 이에 대법은 수정헌법제8조에의해이러한권리의위반을증명하는기준을명확히 clarified the standard for proving a violation of this right under the Eighth Amendment 했고 권리가 있다고 판결함.
5. Johnson v. California (2005). 이 사건은 수감자를인종별갱단으로격리할수있는지 whether race-based prison gangs could be used as a basis for segregating inmates, 교도시스템내인종기반의차별이수정헌법제14조에규정된평등보호조항을위반하
는지 whether race-based segregation in California's prison system violated the Equal Protection Clause of the Fourteenth Amendment 여부를 다루었고, 대법원은 그러한격리는교도소의교정이익을촉진하기위해서만허용 such segregation was only permissible if it was necessary to further a compelling government interest 되고, 교도관은그보다덜제한적인대안이없음을입증해야 prison officials must show that no less restrictive means were available 한다고 판결함.
6. Brown v. Plata (2011). 이 사건은 캘리포니아 주 교도소의 수감자 과밀 overcrowding 문제와 그로 인한 수정헌법제8조의수감자권리침해 the resulting violation of inmates' Eighth Amendment rights 를 다루었고, 대법원은 주의 교도소 수감시스템이 너무과밀하여잔인하고이례적인처벌 so overcrowded that it amounted to cruel and unusual punishment 에 해당한다고 판결하고 주정부에 교도소 수감자 인원수를 줄이도록 명령함.
