2022년 2월 1일 현재 미국 법원에서 사용중인 민사소송 Defendant’s Answer to the Complaint 서식입니다.
미국 법원에서 피고의답변서 the Defendant's Answer to the Complaint 는 원고가 피고의 혐의를 기술해 법원에 제출한 소장에 피고가 대답하는 법적 문서입니다.
피고의 답변은 원고의 혐의주장에 대한 응답이자 혐의에 대한 방어를 법원에 제시하는 절차로 매우 중요한 단계이며 원고의 소장을 받은 날로부터 21 ~ 30일 내에 답변서를 제출해야 합니다.
답변서에는 다음과 같은 요소를 기재합니다:
1. Caption : 법원,사건번호및관련당사자이름을작성합니다 identifies the court, the case number, and the names of the parties involved.
2. Introduction : 제시된 혐의 allegations 들을 인정 admits 하거나 부인 denies 하고, 혐의의진실여부를판단할충분한정보가없다는것을명시할수 can state that they do not have sufficient information to form a belief as to the truth of the allegation 있습니다.
3. Affirmative Defenses : 피고는 입증된 경우 if proven, 원고의 주장을 무효화할 수 있는 긍정적방어를할수 may raise affirmative defenses 있는데, 그것에는 소멸시효 statute of limitations , 관할권부재 lack of jurisdiction, 그리고 주장의사실부족 failure to state a claim 등이 있습니다.
4. Counterclaims : 피고는 원고에게반소청구를할수도 may also assert counterclaims against the plaintiff 있습니다. 반소 청구란, 피고가 원고의주장과같은거래또는사건에서발생한 arising out of the same transaction or occurrence that gave rise to the plaintiff's claim 피고의 청구입니다.
5. Prayer for Relief : 피고의 답변서는 구제방안 prayer for relief 으로 마무리 하는데, 피고가 법원에 요청하는 내용으로, 원고의청구를기각 dismiss the plaintiff's claims 하거나 반소청구에서 피고에게손해배상을지급하도록 award damages to the defendant on their counterclaims 하는 요청을 기재합니다.
다음은 미국 대법원의 "Defendant's Answer to the Complaint" 민사소송 사례입니다:
1. Twombly v. Bell Atlantic Corp. (2007): 이 사건에서 피고인 Bell Atlantic Corp.는 원고인 Twombly가 연방반독점법을위반하여 violation of federal antitrust laws 부당경쟁행위를했다 had engaged in anticompetitive behavior 는 주장에 대한 답변서를 제출했고, 원고의 청구가 기각 당하지 않기 위해서 어느 정도의 상세한 주장이 필요한지를 다룸 The case raised issues related to the level of detail required in a plaintiff's complaint to survive a motion to dismiss.

Iqbal (2009): 이 사건에서 피고인 전 미국법무장관 former Attorney General of the United States, John Ashcroft 는 원고인 파키스탄 출신의 무슬림 시민 Javaid Iqbal 의 인종및종교차별 racial and religious discrimination 주장에 대해서 답변서를 제출했고, 정부고위공무원이공무중에취한행동으로얼마나책임을져야하는지 The case raised issues regarding the extent to which high-level government officials can be held liable for actions taken during the course of their official duties. 를 다룸.
3. Wal-Mart Stores, Inc. v. Dukes (2011): 이 사건에서 피고인 Wal-Mart Stores, Inc.는 여러 여성종업원들이 회사가 성차별 gender discrimination 을 했다는 주장에 대한 답변서를 제출했고, 차별 송에서원고대리인의인증 문제 The case raised issues related to the certification of a class of plaintiffs in a discrimination lawsuit 를 다룸.
4. Comcast Corp. v. Behrend (2013): 이 사건에서 피고인 Comcast Corp.는 원고인 Behrend가 연방반독점법 violation of federal antitrust laws 을 위반하여 부당경쟁행위 anticompetitive behavior 를 했다는 주장에 대한 답변서를 제출했고, 이 사건은 단체소송에서손해배상이공통적방법으로계산될수있는지 The case raised issues related to the requirement that damages in a class action lawsuit be capable of calculation based on a common methodology 를 다룸.
5. United States v. Texas (2016): 이 사건에서 피고인 Texas 는 텍사스유권자신분증법 Texas's voter ID law 의 합헌성에 이의를 제기한 미 법무부의 주장에 대응하여 답변서를 제출했고, 이에 대법원은 투표관행을규제할수있는주의권한범위와 그러한규제가 소수자투표권에미치는영향 The case raised issues related to the extent of a state's power to regulate voting practices and the impact of such regulations on minority voting rights 문제를 다룸.
