2022년 1월 1일 현재 미국 법원에서 사용중인 민사소송 Complaint for a Civil Case 서식입니다.
민사소송에 대한 소장 Complaint for a Civil Case 은 원고가 피고를 상대로 법원에 제출하는 법적 문서로 피고에 대한 원고의 주장을 하고 피해또는부상에대한구제책을요구seeks a remedy for the harm or injury that has been suffered 합니다.
소장에는 관련 당사자identifies the parties involved 와 제기되는 법원 the court where the case is being filed, 분쟁을초래한사건 the factual allegations, 피해를야기한 피고의작위또는부작위 the defendant's actions or inaction that caused harm, 그결과원고가입은손해또는부상 any damages or injuries suffered by the plaintiff as a result, 원고 주장의근거 the legal grounds, 원고가구제를구하는법적근거나사유 causes of action upon which the plaintiff is seeking relief. , 계약위반 breach of contract, 태만 negligence, 사기 fraud 또는 청구에대한기타인정된법적근거 any other recognized legal basis for a claim, 법원에 구하는 특정구제또는구제책 a statement of the specific relief or remedy, 금전적손해 monetary damages, 금지명령구제 injunctive relief 또는 특정 이행 specific performance 을 기재합니다.
소장이 법원에 접수되면 피고는 답변으로 답변할 기회를 갖게 되며, 원고의 주장을 인정하거나 부인하며 방어 또는 반소를 할 수 있습니다.
다음은 미국 대법원 Complaint for a Civil Case 관련 판례입니다.
1. Marbury v. Madison(1803): 이 사건은 대법원이 의회의법안을위헌으로판단할때 효력없으로결정할권한을부여 which gives the Supreme Court the power to declare acts of Congress unconstitutional 하는 사법심사원칙을확립 established the principle of judicial review 했음.
2. Dred Scott v. Sandford(1857): 이 사건은 원고인 자유를추구하는노예 a slave seeking his freedom 가 제기한 민사 소송으로 대법원은 최종적으로 노예 제도를 지지한 판결을 함.
3. Brown v. Board of Education(1954): 이 사건은 공립학교의 분리는했지만평등하다는원칙 separate but equal" doctrine 에 대해서 아프리카계미국인부모 African American parents 인 원고가 제기한 민사 소송으로 대법원은 그 원칙이 위헌 struck down as unconstitutional 이라는 판결을 내림.
4. Roe v. Wade(1973): 이 사건은 낙태를금지하는텍사스법 a Texas law prohibiting abortion 에 이의를 제기한 원고의 민사 소송에 대법원은 낙태에대한헌법상의권리를확립 ruling established a constitutional right to abortion 했음.
5. Bush v. Gore(2000): 이 사건은 2000년 플로리다주에서의 대통령선거 presidential election 결과에 앨 고어의 대선캠페인 the presidential campaign 측이 제기한 민사 소송으로 대법원은 조지 부시에게 대통령직을 부여 ruling effectively awarded the presidency 했음.
