이 글의 목적은 협정의 주의사항과 다른 외국의 견해를 알고 더 나은 해법을 찾도록 하는 것이 목적입니다.

1. 용어정의 (ABC순)
* ASEAN : 아세안. Association of Southeast Asian Nations.동남아시아 국가 연합.
* CPTPP : 시피티피피. Comprehensive and Progressive Agreement for Trans-Pacific Partnership. 포괄적·점진적 환태평양경제 동반자 협정.
* FTA : 에프티에이. Free Trade Agreement 자유무역 협정.
* ILO : 아이엘오. International Labour Organization 국제노동기구.
* RCEP : 알셉. Regional Comprehensive Economic Partnership. 域內包括的經濟同伴者協定. 역내 포괄적 경제 동반자 협정.
초기에는 미국 주도의 TTP에 대응하려고 중국 주도로 아세안 10개국(브루나이, 캄보디아, 인도네시아, 라오스, 말레이시아, 미얀마, 필리핀, 싱가포르, 태국, 베트남)과 한·중·일·호주·뉴질랜드 등 15개국이 참여해 만듦.
한국은 2022년 2월 1일에 협정을 발효했고, 인도는 컨설팅, IT, 소프트웨어 외에는 농업, 공업에서 중국에 경쟁력이 약해서 불참함.
* TPP : 티피피. Trans-Pacific Partnership. 환태평양 경제 동반자 협정.
초기에는 미국의 주도로 중국을 견제하고자 만들었으나 현재 미국은 탈퇴했고 유럽연합이 미국의 회귀를 촉구중..
* TTIP : 티티아이피. Trans-atlantic Trade and Investment Partnership. 범대서양 무역 투자 동반자 협정.
2. 외국의 견해
* 중국 : RCEP 외에도 동아시아 경제권의 긴밀한 연결 전략인 3대 경제권 분할(독일 - 프랑스 중심의 유럽, 미국 - 캐나다 - 멕시코의 북미, 중국 - 일본 - 한국의 동아시아) 전략에 따라 TPP 가입도 적극 검토하겠다고 함.
* 일본 : RCEP 외 TPP 참여 확대를 통해 다자주의 자유무역지대를 확대하자고 함.
* 유럽연합 : RCEP을 중국 지도자의 주도로 미국, 유럽에 경제적, 군사적, 정치적인 위협인 "중국 태평양 무역협정” 이라며 유럽연합과 미국이 TTIP, TTP로 함께 대응해야 한다고 함.
* 미국 : 중국이 미국이 주도한 TPP에 대응하기 위해 RCEP을 만들어서 서로의 협정 회원국인 Partner들 사이에 문제가 예상.
유럽연합과 미국이 TTIP, TTP로 함께 대응할 필요는 있지만 현재 미국은 이미 탈퇴한 TPP에 재가입 하기 보다 보호무역을 통한 일자리 보호와 산업 보호를 원함.
3. 주의사항 :
* FTA가 아님.
경제동반자협정인 RCEP는 무관세인 자유무역협정인 FTA가 아님. FTA로 무관세를 못한 이유는 ASEAN이나 남아시아국들이 자국 산업을 한중일로부터 보호하기 위해 개방에 소극적이었기 때문.
* 한국은 RCEP 가입국 중 일본을 제외한 대부분 국가와 FTA를 체결했고, 개방률이 가장 낮은 아세안 FTA에서도 아세안 국가들과 개별 FTA를 체결하여 RCEP로 인한 경제적 효과는 적음.
* RCEP의 낮은 무역 개방률.
공산품 무역 개방률이 한-ASEAN FTA보다는 높지만 91~94.5%로 한미 FTA, 한EU FTA의 100%에 미치지 못함.
* RCEP의 낮은 농산물 개방률.
낮은 개방률로 고작 정치적 합의일 뿐이라는 비판이 있음.
한국: 한칠레 FTA, 한미 FTA, 한EU FTA의 농산물 개방률이 98%였던 것에 비해 50% 전후임.
일본: 각종 예외 조항으로 농산물 개방률이 46% 전후임.
호주: 농산물 개방률 0.1% 전후임.
중국: 농산물 개방률 0.2% 전후임.
* RCEP의 중국 인권, 서비스, 노동.
중국은 인권, 서비스, 노동 문제 등 역내 교류 확장을 위한 논의를 봉쇄했으며 이것은 한중 FTA에서도 지적된 문제임.
반면, TPP는 역내 가입국 국민들을 평등하게 대하고 국제노동기구(ILO)의 노동조약 비준을 넣는 등 인권개선 및 법제개선에 대한 내용이 삽입됨. 한국이 TPP에 가입할 경우 현재 ILO의 협약 중 4개 조항에 대해 분단국가의 특수성과 병역법 등을 이유로 비준하지 않는데 이해관계 충돌이 예상됨.
* RCEP의 지적재산권
중국의 압력으로 합의되지 않고, 협정문 지식재산권 Chapter 11에 "각 국가에서 유지하고 있는 지적재산권 제도에 따른다"로 함.
이것은 외국기업이 중국에서 영업할 때 중국 파트너에게 51%의 지분을 인정하고, IT 기업들은 중국 공산당에게 프로그래밍 소스 코드를 제공하고, Contents 기업들은 콘텐츠를 중국 파트너에게 제공해야 하는 등 차별에 문제가 많음.
반면, TPP는 지적재산권에 저작권, 특허, 의장권, 상표권 등 모든 지적재산권 분쟁에 대한 조정에 합의함.
* 한국은 RCEP은 개방률이 낮아서 TPP에 동시 가입하는 것이 좋지만 TPP 가입시 쌀의 무관세 개방으로 농민들의 반발이 예상됨.
* TPP 가입에는 결정을 계속 미뤘던 것과는 대조적이라서 한중 FTA의 연장선, 중국 주도의 정치군사 협정이다 라는 평이 있음.
* CPTTP(포괄적·점진적 환태평양경제동반자협정) 확대를 통해 지역경제 통합 촉진이 필요.
* TPP에서 탈퇴한 미국이 재가입할 경우 RCEP과 TPP를 동시에 가입한 회원국들의 문제와 TPP에 가입하지 않았지만 미국이 재가입시 가입을 권유할 회원국들의 문제가 예상됨.
* TPP는 미국이 중국에 대응하기 위해 만들었고, RCEP은 중국이 TPP에 대응하기 위해 만들어서 미국과 중국이 서로의 협정 회원국인 Partner들 사이에 문제가 예상되지만 현재 미국은 TPP 재가입 보다 보호무역을 통한 일자리 보호와 산업 보호를 원함.

PREAMBLE
The Parties to this Agreement,
RECALLING the Joint Declaration on the Launch of Negotiations for the Regional Comprehensive Economic Partnership adopted by the Heads of State or Government of the Member States of the Association of Southeast Asian Nations (hereinafter referred to as “ASEAN” in this Agreement) and Australia, China, India, Japan, Korea, and New Zealand at Phnom Penh, Cambodia on 20 November 2012 which endorsed the Guiding Principles and Objectives for Negotiating the Regional
Comprehensive Economic Partnership;
DESIRING to broaden and deepen economic integration in the region, strengthen economic growth and equitable economic development, and advance economic cooperation, through this Agreement, which will build upon existing economic linkages among the Parties;
ASPIRING to strengthen their economic partnership to create new employment opportunities, raise living standards, and improve the general welfare of their peoples;
SEEKING to establish clear and mutually advantageous rules to facilitate trade and investment, including participation in regional and global supply chains;
BUILDING upon their respective rights and obligations under the Marrakesh Agreement Establishing the World Trade Organization done at Marrakesh on 15 April 1994, and the existing free trade agreements between the Member States of ASEAN and their free trade partners, namely Australia, China, Japan, Korea, and New Zealand;
TAKING ACCOUNT OF the different levels of development among the Parties, the need for appropriate forms of flexibility, including provision for special and differential treatment, especially for Cambodia, Lao PDR, Myanmar, and Viet Nam as appropriate, and additional flexibility for Least Developed Country Parties;
CONSIDERING the need to facilitate the increasing participation of Least Developed Country Parties in this Agreement so that they can more effectively implement their obligations under this Agreement and take advantage of the benefits from this Agreement, including expansion of their trade and investment opportunities and participation in regional and global supply chains;
RECOGNISING that good governance and a predictable, transparent, and consistent business environment will lead to the improvement of economic efficiency and the development of trade and investment;
REAFFIRMING the right of each Party to regulate in pursuit of legitimate public welfare objectives;
RECOGNISING that the three pillars of sustainable development are interdependent and mutually reinforcing, and that economic partnership can play an important role in promoting sustainable development; and
FURTHER RECOGNISING the positive effect that regional trade agreements and arrangements can have in accelerating regional and global trade and investment liberalisation, and their role in strengthening the open, free, and rules-based multilateral trading system,
